The wali (guardian, usually the bride's father) plays an important role in a Nikah. Questions often arise when a wali is absent, has passed away, or is not Muslim.
The scholarly view
The majority of scholars consider the wali a condition for a valid Nikah, acting in the bride's best interest. The Hanafi school takes a different position for an adult woman.
When the wali is unavailable
If the father has passed away, guardianship may move to the next male relative in order (grandfather, brother, and so on). Where no suitable wali is available, a recognized Muslim authority (such as an imam) can act as wali.
